Terms of Service
These Terms of Service govern the use of the MedHistory platform (hereinafter: the "Platform") provided by the company RUBISCO DOO (Tax ID (PIB): 113190109, Company ID no.: 21820300, hereinafter: "Rubisco", "we"). By registering for and using the Platform, the doctor or healthcare institution (hereinafter: the "User", "you") accepts these Terms.
1. Subject of the service
The Platform is a software tool that helps the User organize their patients' medical records: it recognizes text in uploaded documents, arranges data into a timeline, extracts the most important information and makes it possible to ask questions about those records. The Platform does not provide healthcare services.
2. Account and registration
- An account may be opened only by a healthcare professional licensed to practise or by a healthcare institution.
- You must provide accurate information when registering and keep it up to date.
- Your account is personal. You must not share your login credentials with anyone else, and you are responsible for all activity on your account.
- You must notify us immediately of any unauthorized access to your account.
3. Your responsibility for patient data
For the medical records and patient data you upload to the Platform, you are the data controller within the meaning of the Law on Personal Data Protection (the "LPDP"). Rubisco processes that data solely as a processor, on your instructions and only in order to provide the service. By accepting these Terms, you confirm and undertake that you will:
- upload only records of patients for whom you have their consent or another valid legal basis for processing;
- inform patients appropriately about the processing of their data, including the use of a tool of this kind;
- not upload records of persons who are not your patients, or records obtained unlawfully;
- comply with regulations on professional secrecy and on patients' rights.
You alone are responsible for the lawfulness of the uploaded records and for the existence of a basis for processing them. Provisions on the processing of data on behalf of the User are described in more detail in the Privacy Policy.
4. Rubisco has no relationship with your patients
- Rubisco has no contractual or healthcare relationship of any kind with your patients.
- We do not contact your patients, provide services to them or use their data for our own purposes.
- If a patient contacts us about their data, we will refer them to you as the controller and provide you with technical support in handling the request.
5. The Platform is not medical advice
The views, summaries and answers that the Platform generates with the help of artificial intelligence serve solely as an aid in reviewing records and may contain errors or be incomplete. Every piece of data is linked to the original document, and you must verify it before using it. All medical assessments and decisions are made by you alone, in accordance with professional standards.
6. Trial period and payment
- A doctor who registers independently receives a free 30-day trial period, without entering a payment card.
- After the trial period ends, continued use of the Platform is subject to subscribing to a paid service. We will inform you of the terms before the trial period ends.
- If you do not continue using the Platform, your data is retained and deleted in accordance with Section 9.
- For clinics and healthcare institutions, the terms of use and payment are agreed separately.
7. Acceptable use
You must not:
- use the Platform unlawfully or for purposes unrelated to the healthcare of your patients;
- attempt unauthorized access to the Platform or to other users' accounts or data;
- disrupt the operation of the Platform or overload it with automated requests;
- copy, modify or resell the Platform or any part of it.
Violation of these rules may result in temporary or permanent suspension of your account.
8. Limitation of liability
We provide the Platform "as is". We take reasonable technical and organizational measures to keep the Platform available, accurate and secure, but we do not guarantee uninterrupted, error-free operation. To the extent permitted by law, Rubisco is not liable for damage arising from medical decisions made on the basis of what the Platform displays, from the content of records uploaded by the User, or for indirect damage and lost profits.
9. Termination, data deletion and export
- You may close your account at any time by sending a request to the contact address below.
- Before closing your account, you may request an export of your data.
- After your account is closed, or after the trial period ends without continued use, we delete your data within the periods set out in the Privacy Policy.
10. Changes to these Terms
We may amend these Terms from time to time. The current version is always published on this page, with its version number and date. We will notify you of material changes in advance, and you will need to accept the new version to continue using the Platform.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Serbia. Disputes fall under the jurisdiction of the court in Belgrade having subject-matter jurisdiction.
